Before you shortlist
Start with a written brief specifying the intended game format, original assets and changes to existing technology. Compare full development with a narrower personalisation project, then ask each supplier to identify deliverables, dependencies and approval milestones.
Agree ownership and reuse rights separately from commercial exclusivity. The contract should address supported territories, certification responsibilities, distribution, acceptance testing, maintenance and changes after launch. Compare proposals with the same scope; a visual reskin and a new game are not equivalent projects.
Is this commissioned development, personalisation or another defined service?
Which parts of the game are created or changed?
Which design, implementation, testing and launch deliverables are included?
Which mechanics, assets and brand elements can change?
What intellectual-property, reuse and exclusivity terms can be agreed?
How are milestones, acceptance and ongoing maintenance organised?
How are development, approvals, distribution and support priced?
A commissioned project has a defined creation or modification scope. RubyPlay’s published example distinguishes bespoke development from lighter personalisation; existing catalogue licensing is a separate buying decision.
SourceExclusivity and ownership address different rights. A bespoke proposal should state the territories, duration, asset ownership and permitted reuse rather than relying only on the word exclusive.
